Mist Works Limited Warranty
Mist Works hereby warrants, subject to the conditions set forth below, that it will either repair or replace, at its option, the product if it proves to be defective by reason of improper workmanship or materials within the limited warranty.
Scope of Warranty: All Mist Works systems are warranted against defects in workmanship and materials. Mist Works does not warranty components due to normal wear, including pump seals, valve seals, nozzles and mist rings, pulley belts, filter elements, and additional other items that may not be listed.
Repairs outside the scope of the warranty: problems with Mist Works products can be due to improper maintenance, faulty installation, inappropriate additions or modifications to the system, or other problems not due to defects in Mist Works workmanship or materials. If the Mist Works Service Center determines that the problem with the product is not due to defects in workmanship or materials, the customer will be responsible for the cost of any necessary repairs and any freight expense to return the product to the customer.
Warranty Period: Mist Works “Gulf Breeze",“Bay Breeze,” and “Penny Pincher / RCD Models” model pumps are warranted for parts only for a period of six (6) months from the date of sale. Sports Mist portable fans, Mist 2 Go portables, high-pressure and mid-pressure pumps, all 18BVSS, 24BVSS, and 24B1SS are warranted for parts only for a period of one (1) year from the date of sale. Fan warranty is limited to motor, bearings, and blade for a period of 12 months from the date of sale. All “EXD”, PhD” or “WAVE” model pump heads, motors, pressure switches, and solenoid valves are warranted for a period of 24 months (12 months for systems running chemicals) from date of sale, parts, and in-house labor 1st year, parts only (2nd year). All warranty claims must be submitted to the Mist Works Service Center prior to the expiration of the warranty period. Any warranty service requested for onsite (not returning product to Mist Works service center) will be billed for service call and labor according to the above referenced time period.
Warranty Validation: The warranty is activated automatically when the product is delivered to the customer.
Procedure to Receive Warranty Service: To return Mist Works products for warranty service, call Mist Works at 850-203-1998 for a Return Authorization Number. Customers should then properly pack and secure all products to a pallet or in a secure box and ship prepaid (we recommend insured as well) to Mist Works. An explanation of the defect or problem; a description of the way in which the Mist Works product is used; the customer’s name, address, and telephone number; and the pump model number. The return authorization number must be noted on the outside of the shipment.
Repairs by Others than Mist Works: Mist Works must provide prior approval for any repairs done outside the Mist Works Service Center, or the Mist Works Warranty will be void. Repairs or Replacement within the Scope of the Warranty: If a Mist Works product is defective due to Mist Works workmanship or materials and the defect occurs during the warranty period, then Mist Works will either repair or replace the product at Mist Works’ discretion. If the defect is not due to Mist Works workmanship or materials, the customer will be responsible for bench time for analyzing the product and repairs, including labor and parts if the customer wishes the product to be repaired.
Product Specification: All product specifications, applications, and other information provided in Mist Works’ publications are subject to change without notice and should be confirmed with Mist Works prior to ordering.
WHAT IS NOT COVERED UNDER WARRANTY
Defects due to alteration of product, abuse, damage by misuse or abuse, physical damage, ordinary wear, usage with anything other than potable water source, modifications, and alterations by the customer, or failure to follow usage instructions. Damages by acts of God or disasters are not covered. Product that has not been properly maintained per recommendation by Mist Works Maintenance & Winterization guide (i.e., oil changes every 500 hours, emptying out filter canisters to avoid freezing, changing filters, running fluids other than water through the system, etc.) are not covered.
Damages to property or economic loss beyond the purchase price of our products.
Mist Works is not responsible for the removal and shipping of the system to the service center, the re-installation of the system upon its return to the customer, or any incidental or consequential damages resulting from the defect, removal, re-installation, or shipment of the product.
No Other Warranties and Liability Limitation: This Limited Warranty and Service Policy represents Mist Works’ sole and exclusive warranty obligation with respect to Mist Works products. Mist Works’ liability to a customer or any other person shall not exceed the purchase price of the Mist Works system. Mist Works disclaims all other expressed and implied warranties, including the implied warranties of fitness for a particular purpose and merchantability. Buyer agrees the sole remedy for breach of any and all warranties and for manufacturer's liability (including, without limitation, liability for negligence) will be limited to the repair or replacement of the product.
Under no circumstances shall Mist Works be liable for consequential or incidental damages in connection with this product. To the extent Mist Works is prohibited by applicable law from excluding implied warranties, the duration of such implied warranties, which are not excludable, shall be the original purchaser’s lifetime. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Prices and quotes are subject to change without notice. Mist Works is not responsible for typographical errors on any print or electronic copies of warranty.
Return policy
If your product is defective, contact us at 850-203-1998. Your obligation is the freight charge to return the item, provided your return is complete with original packaging, all documentation, warranty cards, cables, etc. Once Mist Works receives, inspects, and tests products, we will repair or replace them at our discretion. RGA # required.
Mist Works may, at our discretion, accept returns for non-defective items, on a case-by-case basis. All items must be shipped at the customer's expense, pre-paid, in original packaging with all components returned in new/unused condition as sent out by Mist Works and in resalable condition, and require an RGA #. No used items nor special order items may be returned. A 25% restocking fee will apply. Funds will be credited as store credit minus original shipping cost (to the customer).
Shortage, discrepancy, or damaged goods must be reported within 5 days of receipt; no exceptions.
Right to Refuse Service
Mist Works reserves the right to refuse services to anyone, for any reason. While we never, ever want to do this, we will when we feel a client is not respectful of our employees and/or our business.
Custom Designs
Mist Works charges a design fee for custom layouts prior to purchase. These design fees can be credited towards your product purchase should you decide to proceed with the system quoted. If you do not purchase from Mist Works with a valid estimate, the fee is considered payment for design services. Fee is 10% of retail price of products quoted, with a minimum of $350.
Commercial Estimate
Mist Works may charge an estimate fee if an onsite visit is required. This fee can be credited towards your product purchase should you decide to proceed with the system quoted. Fee minimum $200
Sales and Discounts
From time to time, Mist Works is able to offer discounts and/or sales on certain items. Sales, discounts, and free/discounted shipping offers are not valid when using Trade/Barter organization funds and are valid for cash/check payments only unless otherwise noted. While there may be a sale “valid through” date, the sale can end when supplies are exhausted or at Mist Works discretion.
Acceptable Payment Methods Eff
Our customary and preferred method of payment for all sales and rentals, other than online web sales, is cash, check, or ACH. We reserve the right to refuse credit card payment for large orders. We will charge a 3.75% fee on payments made via credit card.
Service Calls
Local area service calls after regular business hours, weekends, and holidays will increase by 50%. Service calls outside our local area (within 25 miles) may incur additional charges. If we arrive to provide service and are not able to access the system due to an issue on the client side, time will be billed from the time of arrival.
